The following are some states with the links (I hope the links work) to the individual states Dept of Labor. Be sure to read all of any instructions and follow exactly as the states say. Some states have no individual wage claim laws and fall under the US Dept of Labor for filing wage claims. For many states there are time limits for filing. Also some states state that you can either file the unpaid wage claim or take the employer to small claims court, some states state that there is a specific amount you have to be over/under for the small claims court. I am not responsible for any content on any of these sites. Always verify things for yourself. Some states web sites are not user friendly and I was not able to find information on filing unpaid wages, you can call the individual states dept of labor and ask where you go to get the needed information for unpaid wages. Usually you have to file the unpaid wage claim in the state that the agency/employer is located. For example; I filed with the Texas employment commission against richards healthcare who are based in Houston TX, and I had worked a contract in Ms. It took about 5 months to get the monied owed me. It is against federal law to withhold monies owed. Syl

AL WAGE PROCEDURES

AZ If your employer fails to pay your wages, you may either file a complaint with the Industrial Commission of Arizona or you can file a complaint in court. If you file a claim in court, then you can ask for treble damages, which is up to three times the amount of wages owed, but the judge decides whether you will receive the treble damages. (ARS 23-355). You cannot be awarded treble damages by the Industrial Commission of Arizona, but it may take less time, depending on the court you choose.

If you have overtime and/or minimum wage violations, you can file a claim with the Wage and Hour Division of the federal Department of Labor. The contact information and location for all of the Maricopa County Justice Courts is listed in the Forms and Letters tab of this site. The Industrial Commission of Arizona is at 800 W. Washington Street, Phoenix, AZ 85007, 602-542-4411. The US Department of Labor is at 3221 N. 16th Street, Room 301, Phoenix, AZ 85016, 602-640-2990.
