    HELP LPN poss. $100 FINE

    Can anyone help me or give me some advice. I am sorry for the long note, I am just really upset & scared.
    I have been an LPN for about 5 years now. 2 years ago I was doing some night work for extra cash with an agency at a Nursing home.....Anyway, a CNA called me & told me to look at this woman's legs, she said they "looked funny". I pointed to what looked to me like spider veins & she said yes. ROM done & no s/s pain. So I continued with the rest of my 40 residents (I am the only nurse w/ 2 CNAs). OK, come to find out 2 days later that same resident had BLE Fx. They did an investigation & 3-11 CNA admitted to transfering res. to bed alone (supposed to be 2 person transfer). I was asked to leave because the night CNA told them that she reported it to me....which was true but I honestly didn't see anything. 2 years now & an attorney from NYS dept. health calles me to tell me that I have a $100 fine or I can fight it in court. The money isn't the issue I don't want anything on my license for the rest of my life. She told me that since there is a nurse shortage that it 'might' not go on my license since I have no priors (yeah right) The attorney told me that the CNA's statement does say that I am always a good nurse & that I always have my note book next to my med cart & when they tell me anything that I always right it down except for this one thing because it was busy that night. I know I am at fault for not writing it down, but if I don't see something then what is to right down. The attorney said "There most of been something because she had Bil fractures"
    My question is..Is there a chance I can beat it or should I just take the $100 fine for failing to chart? I am going on for my RN & this will stay with me & haunt me for the rest of my life.
    Is there a nurse help number I can call for New York?

    The best thing to do is to speak with a lawyer. Your license IS important, right?

    Oh,man, that is crap. I thought that assessment and teaching were the two areas that belonged to an RN and that they couldn't be delegated. Wouldn't that fall under assessment? I would talk to a lawyer because I think the situation is messy. I really feel for you. I don't know what the legs looked like, but it's tricky if they were both broken because then they both looked the same, which one would assume is normal unless it was an obvious deformity or problem. I hope everything works out for you. I don't know what I'd do because I wouldn't want that on my record either. I think it sucks.
