Privacy issues

I have a couple of questions and would appreciate some answers.

1. Do any of you fellow members feel at risk because the bon are no longer just putting your name on the public list of diciplinary actions, they are now including every detail of a contract and the actual offense the nurse is accused of posted online.
If you enter your name on google see what pops up.
Let me know what you find

I guess they have figured a way to get around privacy laws. I had been told by someone in a recovery program that there are special rules about the privacy of people who are involved with mental health or addiction problems. It seems like there is a contradiction here.

The thing is that once charges are filed which must be done to revoke a license all the case records become public record and no longer protected by privacy laws like HIPPA - IF you read the HIPPA regulations you see that what being put on the net is in complete compliance with privacy laws.

But if you a practicing a policy of rigorous honesty in your program the people you love already know what's happening in your life.

Because I completed the CA Diversion program without going to probation my records never become public record.

I UNDERSTAND WHAT YOU ARE SAYING. IT'S THE DETAILS THAT I FEEL PLACE NURSES IN A PRECARIOUS SITUATION. I HAVE RESEARCHED ALOT OF DIFFERENT STATE BOARDS AND ALOT OF THEM LIST;
SECTION(REVOKE,SURRENDER,SUSPEND
NEXT; THE NURSE LICENSE NUMBER AND NAME. tHAT IS ALL THEY CAN FIND OUT. IF SOMEONE WANTS MORE INFO THEY HAVE TO PAY FOR IT.
I THINK THE PEOPLE THAT NEED TO KNOW EVERYTHING IS ;
BON IN ANY STATE,ANY POTENTIAL EMPLOYER ALONG WITH ANY LEGAL ENTITIES.
WHY DOES SOME PERSON FROM THE DIETARY DEPT IN A FACILITY NEED TO KNOW ANYTHING ABOUT ME?
AND HOW ABOUT THE PEOPLE THAT LOOK YOU UP,KNOW YOU HAVE SOME SORT OF DRUG HISTORY WITH THE BOARD AND START TO DIVERT THEMSELVES BECAUSE THEY KNOW GUILTY OR INNOCENT,WE ARE GUILTY. THAT IS AN UNDISPUTABLE FACT.
pOLICE OFFICERS DON'T GO ON LISTS,NOR DO FIREFIGHTERS AND SCHOOL TEACHERS. HOW IS THIS FAIR?

Fair or not that's the way it is - In california md and lawyers have their publics records on the net as well. One of the first things one learns in recovery is that life's not fair and we have to stop expecting it to be. Acceptance is the answer - and as DR. Phil says you wouldn't worry so much people thought of you if you realized how rarely they did. I personally never cared what people know about beout me - if asked about my addiction I was and continue to be completely open and transparent. I ahve had only positive experience with this - but maybe I just see things differently.

Just a side note it's not the publication of details that put us in a precarious position it is our past actions prior to recovery while we were in our disease that did that. We have no one to blame but ourselves.

When has this actually occurred?? If there is a suspicion of diversion, it is always a smart idea to voluntarily do a drug test, which will eliminate you as a suspect.

Like By whome - I have never heard of this happening and anyway if you are in Diversion or on probation you are randomely tested which helps to defend you against false accusations and well as relapse. At one point some meds went missing on my floor and I immediatly went to my DON reported the missing meds and offered to test right there - She was flabergasted saying that even with my history (she was my work-site monitor and new all the dirty details) it never crossed her mind that I had taken the missing medication. so I stand by my earlier statement that if you are working a strong program of recovery and staying sober, you have nothing to fear. Remember what the Big Book says about anger and fear - perhaps a re-read is in order for the original poster.
