Do it by the book. Unfortunately this takes time. First have your lawyer fight the allegation before the board. All manner of due process allow for you to call your accuser. If it is an anonymous accuser, then the veracity of the accuser should be challenged. Once you have cleared yourself in front of the board, then sue for them to release the name, or if it was an anonymous accuser, you can sue the employer of the accuser. It is truly sad to see how far the justice system has moved away from the concept of innocent until proven guilty, and even farther from the founder's concept of facing your accuser. Good luck.

in a situation like that, you are contacted directly by a licensing agency ACHA in some parts of the country and are asked to take a ua if you refuse there is a problem. if you refuse to pee then more than likely there is a problem. most of us don't have a problem with proving people wrong. it happened to me when someone claimed that their valium was stolen by the home care nurse. i was asked to come in an pee, i said i'll be in tomorrow and i was told i will not be able to work if i don't do it "today" i peed and no problem. that's how things are done in a situation like that. the board is not going to allow you to practice when they feel you are not safe for the general population. safety is there number one goal. i certainly hope you get the help you need.

I can see the state board of nursing is attempting to protect the greater good in this situation. They have to assume there is a problem to protect our patients. Still I wouldn't be too happy about it.

I wouldn't have a problem peeing in a cup, long as it was independently tested as well. I would definitely want to have an attorney in my corner.

If I was falsely accused, I can't see submitting to a drug program/probation if there were alternatives. Guess they figure, if someone is using drugs, and wouldn't pass that it gets them into a program to help and under observation in the fastest period of time, without the trauma of a hearing, etc.

With the number of nurses, health professionals, doctors out there abusing, diverting drugs, I can see the need for it.

I've heard of situations like this before happening to nurses male and female. That is why you need to have liability insurance that also protects you if you are called by a BON for investigation. www.nso.com is what I carry and I believe it covers up to $12000 per incident for legal fees regarding your defense in a BON investigation which should be able to provide you with an attorney that specializes in dealing with a specific BON. Fortunetly I haven't had to use it but I'm glad it's there. I believe I pay like $89/yr for this.

The facts remain that we are held to a higher standard here than in any other field (MEN that is). I too have fallen victim to the slander monster and it is prooving almost impossible to work my way up the career ladder because of it.
I do know who is behind this and I also have some very good friends who have backed me in my plight, but it seems that the only way to get rid of the problem is to get a full confession written in blood, and we know how long we can wait for somthing like that to happen.
The only saving grace for me was I happened to find (by chance) the actual person responsible for what I was accused of and they confessed to the crime I was beeing investigated for, but that has not stopped that persons "friends" from making my life mizzzzzzzzerable.
IE: This persons friends were the D.O.N. and several of the nursing supervisors in the facility. You would think they'ld be happy the proper person came forward.
In saving my own reputation as well as my lisence I have been labled as: "Unwilling to cooperate with co-workers." :39: Huh?:whatever:
To top it all off the guilty party still has a job with that facility and I do not.
When asked why the 'Powers that Be' said "He/She still has a job because of the honesty it took to come forward and admit to a wrong doing".
