Re: ASK A NURSE

Hello, I am desperate for help in the legal department. I work in a Level ! Trauma Unit, and its like working with a bunch of high school kids; but to get to my problem: as I was working today, my manager came and got me and said we were going for a walk. When we got to the elevators I asked her what was going on? She stated that the charge nurse (by the way hates my guts) and the Help All and came to her and stated they thought I was drunk or on some kind of drugs. I said that was ridiculas, but she escorted me directly to occupational health and said I had to take a beathalizer test and pee in a cup. I was in total shock!! She stated I must comply or be fired. When I was left alone with the occupational nurse, she gave me the breathalizer test and posted it negagtive. Then she asked me if I had taken in medication in the last 24 hours. I told her that I have Hep C and when I work 2 to 3 days in a row that I hurt very badly and that I had some left over pain pills from another injury that I had received at work and that I had taken 2, and then woke up about 1:00 a.m. in the morning and could not sleep for hurting so I took one more. I was so imbarresed and humiliated that she emptied all my pockets and went to the bathroom with me to pee in a cup. She stated that is I had a perscription for these meds that they might send it back to my manager negaive. But, Im not sure if I broke a rule or not. I did not take any meds prior to work or during work. She has placed me on administrated leave untill the results are in. Please help me, did I do something wrong? Did I brake any rules? This was my 3rd working day in a row and I was kinda quiet, doing my job and charting this morning, but that is no reeason for them to accuse me of such a thing. I am so embarresed and feel slandered. Should I get a lawer, is so what kind? What should I do? I started nursing school when I was 38 years old and graduated when I was 42 because I wanted to be a nurse so badly. Can they fire me or take my licence from me? I live in Nashville, Tennessee, please advise me asap because I dont have but a couple of days to handle this. Please e-mail me back as soon as possible or point me in the right direction.
Sincerely,
Cynthia Madden RN/BSN

Cynthia
It sounds like you work with a bunch of premadonas. I have seen High stress areas like trauma units develop clicks that were like a pack of sharks (I would say wolves but they are warm blooded). Laws differ from state to state, but if you had an rx you may be good to go. There may be a problem, Some places require an rx for a narcotics no be taken over a year since its fill.

The chance of you loosing your license is slim even if it is positive. I think for that to happen you have to be a nurse serial killer or till the nursing board to kiss your but.

The embarrassment of having to do a drug screen because some one reported suspicion of abuse is sad. I am so sorry for the crap you have to take. The stress of Hep-C, plus if you are taking interferon shots just tears you down.

My dear nurse when your drug screen comes back I would find a nice smaller hospital to work at. Trauma is not the only thing in life. I was a "Clinical Trauma Specialist" A trauma course for Dr's that work in ER) at a level 2 trauma center. I have seen the sharks circle and attack, and want nothing to do with them. I have found life away from trauma.

Re: ASK A NURSE

Isn/t there a law to not drug test in your working facility, for fear that they could tamper with it, if they wanted to get rid of you. I think there may be.
Good luck , go online and try to get alot of information on this.

Re: ASK A NURSE

That's very interesting. Our lab tests our empl. urine for drugs. We do the chain of custody bags and logs. with seals signed by the tested person. The kit is sent to our sister hospital where one person does the drug testing. It has stood up in court here.

Now if you hospital can not show chain of custody then you may have a case against the hospital. Only if chain of custody is not followed.

Re: ASK A NURSE

I could not find where "Ask a Nurse" was registered. In fact, I do not believe it can be.

Re: ASK A NURSE

Ask a Nurse is actually registered with another company as a trademark. This is too funny. Go to this website and see for yourself.

http://tess2.uspto.gov/bin/showfield...ate=h51r70.2.3

In fact, HBO had the name registered at one time, now another company has it registered. It is not registered by the person who posted the message on here claiming ownership of the trademark.

But this is the internet - we can say anything and be anybody.

For the record, I am King. Everyone must pay me now. Pay up. Pay da King.... I think I shall register that name as a trademark. lol 2 funny 2 b here.
